Privacy Policy

This is a translation for convenience. The Dutch version is the binding one; if the two differ, the Dutch text applies. Nederlandse versie.

In the Mathieu Coaching app you share things that are personal: your weight, your measurements, what you eat and sometimes a photo of yourself. We handle that with care. Below you can read, in plain language, which data we process, why, what Mathieu sees as your coach, who we share data with and what control you have over it.

In short: we use your data only to build your plan, to coach you and to make the app work. We sell nothing, we show no advertising and we do not track you across other apps or websites. We process your health data only if you explicitly say yes to that yourself. You can withdraw that consent at any time.

1

Who we are

Mathieu Coaching is the coaching app of bodybuilder and coach Mathieu. The app is published, sold and technically operated by AHAM. AHAM is the data controller for the data you leave in the app: AHAM decides what it is used for and how, and is your point of contact for everything to do with your data.

Data controller

  • ·AHAM, sole proprietorship (eenmanszaak) (Anton Hulshof)
  • ·Registered address: Lisdodde 59, 4823 MB Breda, the Netherlands
  • ·Dutch Chamber of Commerce (KvK) number: 83894527 · VAT ID [AHAM – btw-id]
  • ·Email: anton.hulshof6@outlook.com
  • ·Phone: +31 6 22851502

We have not (yet) appointed a data protection officer; we have weighed that decision and will review it as the app grows. Questions about privacy go directly to the email address above.

The coach: Mathieu Coaching

The programs, cues, lessons, recipes and messages in the app come from Mathieu Coaching. Mathieu coaches the members and for that purpose sees part of your data (exactly which part is set out in section 4). Mathieu Coaching does this on behalf of AHAM, under a written agreement: use your data only to coach you, never for anything else, and do not share it with third parties.

  • ·Mathieu Coaching

2

Which data we process

Everything below is either entered by you in the app, or created because you use the app. We do not buy data and we do not collect anything about you from other parties. One exception that is not about you: if you scan a barcode in the food diary, we fetch the product information from Open Food Facts (an open, European product database). We only send the barcode, nothing about you.

Technical logs

Our server keeps standard technical log entries, for example an IP address, a time and which page was requested. We use these only to fix faults and to prevent misuse, and we keep them no longer than needed for that.

Visit statistics (website)

On the homepage of our website and on /app we count visits, without cookies. For each day and each page we store how often it was viewed, by how many visitors, and which link people came through (for example the link in Mathieu's Instagram bio). To count a visitor only once per day, we turn your IP address and browser type into a code, using a secret that changes every day. We do not store your IP address itself, and we delete the codes the following night. What remains are totals per day, without any data about you. Bots and visits by logged-in administrators are not counted.

Waiting list for 1-on-1 coaching (website)

If you join the waiting list for 1-on-1 coaching on our website, we store only your email address and the moment you signed up. You do not need an account for that and it is separate from the app. What we use it for is in section 3, how long we keep it in section 5.

Waitlist for the app (website)

If you join the waitlist for the app on the /app page of our website, we store your email address, the moment you signed up and which link you came through (for example the link in Mathieu's Instagram bio; such a link only carries the name of the channel, nothing about you). If you then answer the question whether you would rather pay monthly or yearly, we store that answer too. You do not need an account and it is separate from the app. What we use it for is in section 3, how long we keep it in section 5.

What we do not collect

3

What we use it for — and on which legal basis

The GDPR requires us to state, for each purpose, the legal basis on which we do something. This is it:

To perform our agreement with you (Article 6(1)(b) GDPR)

With your explicit consent (Article 6(1)(a) and Article 9(2)(a) GDPR)

Health data

Part of what you enter in the app says something about your health. The law calls this a special category of personal data (Article 9 GDPR): it may only be processed if you give explicit consent for it. In Mathieu Coaching this concerns exactly the following data:

  • ·your height, your weight and how active you are, from the intake;
  • ·your weight and your body measurements (waist, hip) from your weekly check-ins;
  • ·your food diary (what you eat and drink, with calories and macros) and the kcal target we calculate from it;
  • ·your progress photos (with their own, separate consent).

Not covered by this consent are your well-being scores from the check-in: how you score on energy and sleep, and how proud you are of yourself. Those are self-reported scores about how you felt, not data about your body. We process them on the basis of our agreement (Article 6(1)(b) GDPR, above), and they remain if you withdraw your consent.

We ask for this consent at two moments, each as a separate question, not hidden in a checkbox next to the terms:

  • ·During the intake: for your height, weight and activity, your weight and measurements from check-ins and your food diary. If you say no, we do not store that data and the app uses a default calorie target. If you later want to track your weight, your measurements or your nutrition after all, the app asks you for consent at that moment. Without consent our server does not store that data.
  • ·At your first progress photo: separately, at the moment you want to upload a photo. Without that consent you cannot upload photos; the rest of the app works as normal.

We record when you gave consent and which version of this text applied at that time, so we can demonstrate that it is correct. If you withdraw, we record that moment too.

Withdrawing consent

You can withdraw your consent at any time, without giving a reason. You do this in the app under Settings → Privacy & data → "Withdraw consent", or by email to anton.hulshof6@outlook.com. Withdrawal takes effect from that moment; what was done before remains lawful.

If you withdraw, we delete that data: your height, weight and activity from the intake, your weight and measurements from all your check-ins, your food diary (including your water counter) and your progress photos. After that the app uses a default calorie target that is not based on your body. What remains: your workouts, your program, your own products, your profile, your account and your check-in moments with your well-being scores (energy, sleep, pride), which are not covered by this consent. You can always give consent again later. We use this data solely to calculate your plan and targets, to show your progress and to coach you. Never for anything else.

With your consent: the waiting list for 1-on-1 coaching (Article 6(1)(a) GDPR)

We use your email address on the waiting list for one thing: to let you know when a place for 1-on-1 coaching becomes available. No newsletter, no offers. Your sign-up is your consent; you withdraw it by sending an email to anton.hulshof6@outlook.com — we then remove your address from the list.

With your consent: the waitlist for the app (Article 6(1)(a) GDPR)

We use your email address on the app waitlist only for emails about the launch of the app: a thank-you email right after you sign up and the message that the app is available to download. No newsletter and no emails about other subjects. We use the channel and your answer to the monthly-or-yearly question only to see where sign-ups come from and to prepare the launch. Your sign-up is your consent. You withdraw it with the unsubscribe link in every email, or by sending an email to anton.hulshof6@outlook.com; we then delete your details straight away.

Because the law requires it (Article 6(1)(c) GDPR)

We must keep payment and invoice data for the statutory tax retention obligation (7 years). We also record that you accepted the terms and asked for an immediate start, because consumer law requires that of us. If you use the withdrawal button, we record your withdrawal for the same reason and send you an acknowledgement of receipt.

On the basis of a legitimate interest (Article 6(1)(f) GDPR)

Keeping the app secure: preventing misuse and fraud, fixing faults, making backups. Our interest is that the service stays reliable; the impact on your privacy is limited because we only use technical data for this.

Keeping track of how often our website is visited and through which channel, so we know what works. For that we only keep totals per day; we delete the daily code we use to count a visitor once the following night (section 2, Visit statistics).

No profiling, no advertising

We make no automated decisions with legal effect about you. The app does calculate your calorie and macro targets and recommends a program based on your intake, but that is a calculation you can adjust yourself and discuss with Mathieu. No decision that costs you anything or denies you anything. We do not sell your data, we do not share it with advertising parties or data brokers, and we do not track you across other apps or websites.

4

Who we share data with

To run the app we work with a few parties. Most of them are processors: they work on our instructions, may not use your data for themselves, and with each of them the arrangements about your data are set out in writing (data processing agreements). One party, Stripe, is itself responsible for the payment. They are:

Transfers outside the EU

Your data is stored in the European Union; our email, too, is sent by Resend from its EU region in Ireland. With payments (Stripe) and push notifications (Expo), data may end up in the United States, and with email (Resend) only if the US company would need to access it from the US. For all three, the transfer is covered by the European Commission's standard contractual clauses, one of the mechanisms the GDPR prescribes for this (Article 46). With Expo this concerns your push token and the text of the notification, and only as long as you have notifications switched on. You can request a copy of those arrangements from us.

In addition, we may have to provide data if the law obliges us to, for example to the Dutch Tax Administration (Belastingdienst) or to a competent authority. In all other cases: we share nothing without your consent.

What Mathieu does and does not see

Mathieu is your coach and also the administrator of the app. In the admin area he sees exactly this per member:

  • ·your name and email address, and since when you have been a member;
  • ·your intake (your goal, why you train, how many days per week, gym or home, your first workout and whether you want a reminder) and the daily calorie target the app calculated from it;
  • ·your program and level, and how many workouts you have completed;
  • ·of your check-ins only your latest weight and the date of that check-in — not your measurements, your scores or earlier check-ins;
  • ·your subscription (plan, price, status, end of the current period, a pause and, if you cancel, the reason you give) and your payments (date, amount, status).

What he does not see: your progress photos (which are technically accessible to you only), your food diary, your individual workouts and sets, your measurements and your well-being scores. In the community he sees what every member sees, plus your profile page even if you have closed it, and a before-and-after comparison that you put in a post yourself.

What other members see

Your profile page — your name, username, avatar, your city or town if you entered it, the program you follow, the month you became a member, your posts, your three numbers (workouts, weeks in a row, posts) and the personal records from cards you shared yourself — can be opened as long as "Profile visible to members" is switched on. That is the default; if you switch it off, that page stays closed.

What you post yourself is a separate choice. Today the Feed tab only shows posts by Mathieu; members cannot post there yet. As soon as they can: if you place a post or a comment, your name, username and avatar are shown with it, even with that switch off — otherwise nobody would know who they are talking to. So you decide per post. You can always delete your own post; the comments under it go with it. If you delete your account, your posts and comments disappear completely — the app already does that today.

What other members never see: your weight, your measurements, your check-ins, your nutrition, your email address, and who you follow. They do not see your progress photos either, with one exception that you create yourself: a before-and-after comparison that you put in a post. Nobody sees who follows you; only the member you start following gets one notification with your name. If you share a workout or routine card with a post, they only see what is on that card — the day, the duration, the number of exercises and sets, and a personal record if you set one.

5

How long we keep data

6

Minors

Mathieu Coaching is for adults. You must be 18 or older to become a member, and you confirm that at checkout. We do not target minors and deliberately do not process health data of persons under 18.

If we notice that a member is younger than 18, we delete the account and all associated data. Are you a parent or guardian and do you think your child has an account? Email us at anton.hulshof6@outlook.com and we will deal with it straight away.

7

Your rights

Under the GDPR you have the following rights. You can use them at any time:

Deleting your account

You can do that in two ways, and you do not have to give a reason:

  • ·In the app: Settings → Privacy & data → Delete my account.
  • ·By email: send a message to anton.hulshof6@outlook.com with the subject "Delete account", from the email address of your account.

If you delete in the app, it happens immediately: your account, your profile, your intake, your training and nutrition data, your check-ins, your photos and your posts and comments in the community are deleted, and a running subscription is stopped at the same time so nothing more is charged. If you email the request, we process it within 30 days, usually much faster, and confirm when it is done. Only the payment data remains for as long as the statutory tax retention obligation runs, unlinked from your name. If you ever used the withdrawal button, the proof of that remains too (see section 5).

Everything about this is also on one page: deleting your Mathieu Coaching account.

Do you want to make a request? Email anton.hulshof6@outlook.com. We respond within one month. To prevent someone else from requesting your data, we may ask you to confirm that it is you.

Not happy with how we handle your data? Let us know and we will sort it out. You also always have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) via autoriteitpersoonsgegevens.nl.

8

How we protect your data

No system is one hundred percent watertight. If something goes wrong despite everything and your privacy is likely to be at risk as a result, we report it to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) within 72 hours and inform you.

9

Cookies

On our website we only use functional session cookies: the cookies needed to log in and stay logged in. These are technically necessary to provide the service, so no consent is needed for them, which is why you do not see a cookie banner with us. We place no analytics cookies, no advertising cookies and no third-party cookies. We count website visits without cookies (section 2).

When you pay, you go to checkout.stripe.com. There Stripe places its own functional and fraud-prevention cookies; Stripe's cookie policy at stripe.com/cookies-policy applies to those.

The fonts of our website are on our own server (self-hosted). So nothing goes to Google or another fonts service when the site loads.

There are no cookies in the mobile app. On your own device the app stores your session, your language choice and, temporarily, the logs that have not yet been synced to our server (sets, food logs and check-ins you entered without a connection); the app sends those as soon as you are online again and after that they are only stored with us. Nothing else.

10

Changes to this policy

If the app changes, this policy may change with it. That will certainly happen: the community feed will open for members, with reporting and blocking (the rules are in the terms, article 12), and a translation service for posts in another language may be added. The date and the version number at the top show which text applies. If it is an important change, such as a new purpose or a new party that processes data, we let you know by email or in the app before the change takes effect. If the change requires new consent, we ask you for it again.
